What Data Do We Collect?
In order to provide the subscribed service, Mistral Informatique, acting as data controller and located at 39, rue Georges Besse, 63100 Clermont-Ferrand (France), collects and processes the following personal data: last name, first name, email address, phone number, job title, and company.
This personal data is processed by Mistral Informatique solely for account management and user-related information purposes.
We may also collect data in order to improve the services offered to Mistral users within your company. If you use MisTab, published by Mistral, by accepting these terms you agree to provide us with information related to the geographical location of the mobile device (tablet or phone) you are using.
How Do We Collect Your Data?
Your location may be determined with varying levels of accuracy using your mobile device’s GPS or information related to nearby elements, such as Wi‑Fi access points, cell towers, and Bluetooth-enabled devices.
After informing you of the collection of GPS coordinates from your tablet or smartphone, and once you have authorized it, data collection is performed in the background, even when the application is not in use. This is done to ensure reliable geolocation and to avoid requiring you to constantly report your position.
Background collection does not affect the normal operation of the device. You may disable this collection at any time.
How Do We Use Your Data?
Geolocation is the only data collected.
The application collects location data to enable route calculation, sales route planning, technician intervention planning, and transport management, even when the application is closed or not in use.
The consultation, collection, and use of this data are strictly limited to these purposes.
Your data is neither rented, sold, nor shared with third parties outside your company.
Naturally, if the user disables the collection of GPS coordinates, neither the user nor other Mistral users within the same company will be able to benefit from these features.
How Long Do We Retain Your Data?
After three months, the collected geolocation data is permanently deleted from the Mistral ERP system.
Terms and Conditions of Use
These are the terms of service for “MisDM” (the “App” or “Application”), “MobiTec”, “MobiDrive”, “MobiVip”, “MobiStac”, “MobiTrans”, and “MisNote”, developed by Mistral Informatique (the “Publisher”).
The Application offers the following features: route calculation, sales travel planning, technician intervention planning, and transport management.
1. Terms of Use
By using the Application, you agree to be bound by these terms and conditions, all applicable laws and regulations, and you agree to be responsible for compliance with any applicable local laws.
If you do not agree with any of these terms, you are prohibited from using or accessing the Application.
The materials contained in the Application are protected by applicable copyright and trademark laws.
2. License of Use

This is the grant of a license, not a transfer of title, and under this license you may not:
i. Disable or circumvent any access control, security, or privacy mechanism of the Application or any included SDK or library;
ii. Modify or alter the further distribution of any included SDK or libraries;
iv. Attempt to decompile or reverse engineer any software contained in the Application, SDKs, or included libraries;
v. Remove any copyright or other proprietary notices from the Application;
vi. Transfer the content to another person or “mirror” it on any other server.

This license shall automatically terminate if you violate any of these restrictions and may be terminated by the Publisher at any time.
Upon termination of this license, you must destroy any downloaded materials in your possession.
3. Disclaimer
The content of the Application is provided “as is”.
The Publisher makes no warranties, express or implied, and hereby disclaims and denies all other warranties, including without limitation implied warranties or conditions of merchantability, fitness for a particular purpose, or non‑infringement of intellectual property or other rights.
Furthermore, the Publisher does not warrant or make any representations regarding the accuracy, likely results, or reliability of the use of the content of its Application, website, or any materials related thereto or linked thereto.
Neither the Publisher nor third parties provide any warranty regarding the data presented in the Application.
The user uses the Application at their own risk.
4. Limitations
In no event shall the Publisher or its third parties be liable for any damages whatsoever (including, without limitation, damages for loss of data or profit, fines, legal damages, or business interruption) arising out of the use or inability to use the Publisher’s Application, even if the Publisher or an authorized representative has been notified orally or in writing of the possibility of such damages.
Because some jurisdictions do not allow limitations on implied warranties or limitations of liability for consequential or incidental damages, these limitations may not apply to you.
Neither the Publisher nor third parties shall be liable for any type of damage caused by the behavior or content of the Application, even if such damage results from improper application behavior.
5. Revisions and Errata
The Publisher does not warrant that the materials in the Application are accurate, complete, or current.
The Publisher may make changes to the content of its Application at any time without notice.
However, the Publisher does not commit to updating the content or databases.
6. Changes to the Terms of Use
The Publisher may revise these Application terms of use at any time without notice.
By using the Application, you agree to be bound by the version of the terms of use then in effect.
7. Governing Law
Any claim relating to the Publisher’s Application shall be governed by French law, without regard to conflict of law provisions.
